Key DUI Laws in Florida
- Legal BAC Limit: It’s illegal to operate a motor vehicle in Florida with a blood alcohol concentration of 0.08% or higher.
- Zero Tolerance for Underage Drivers: Florida’s zero-tolerance policy makes it illegal for drivers under 21 to operate a vehicle with any measurable alcohol in their system.
- Implied Consent: By driving in Florida, you’ve already agreed to submit to chemical testing (breath, blood, or urine) upon a lawful DUI arrest. Refusing carries serious consequences. Under Florida’s “Trenton’s Law,” effective October 1, 2025, even a first refusal can carry a criminal charge in addition to the administrative penalty of license suspension.
- Open Container Laws: Possessing an open container of alcohol in the passenger area of an operating vehicle is prohibited.
- Drug Impairment: Florida DUI law applies to impairment by controlled substances and prescription medications, not only alcohol.

What Is the 10-Day Rule for DUI in Florida?
Florida gives you ten days from your DUI arrest to contest the resulting license suspension. During that window, your arrest citation serves as a temporary driving permit for essential purposes such as work or school.
After ten days, your license faces suspension, partial suspension, or reinstatement depending on whether you requested a hearing and what occurred at it. Don’t let that window close before speaking with an attorney.
