Lewd or Lascivious Conduct Definition & Penalties

According to Florida Law, the crime of lewd or lascivious conduct is committed when an individual intentionally touches a child under 16 years of age in a lewd or lascivious manner or solicits a child under 16 years old to commit a lewd or lascivious act. Lewd and lascivious are synonymous and are defined as lustful, licentious, wicked, sensual or unchaste intent on the part of the person committing such an act.

The penalties for lewd or lascivious conduct depend on whether the defendant was over or under 18 years of age when the sex crime occurred. Lewd or lascivious conduct committed by a person 18 years of age or older is a second-degree felony, which is punishable by a maximum prison sentence of 15 years and a fine of up to $10,000. If the conduct was committed by a person younger than 18, it is considered a third-degree felony that results in a maximum prison sentence of five years and a fine of up to $5,000.

Keep in mind, a conviction results in registration with Florida’s sex offender registry.
