In Florida, the crime of lewd or lascivious conduct is committed when a person intentionally touches a child under 16 years of age in a lustful, sensual, wicked, or unchaste manner on the part of the individual performing the act. The following are potential punishments for lewd or lascivious conduct:

  • Lewd or lascivious conduct – Touching a person under 16 years of age in a lewd manner or soliciting a minor under 16 years old to commit a lewd act. An individual over 18 who commits such an act faces a second-degree felony charge. An individual under 18 commits a third-degree felony.

An individual under 18 who commits such an act on a child less than 12, or an adult who commits such an act on a child between the ages of 12 and 16 faces a second-degree felony.
  • Lewd or lascivious battery – Anyone who engages in sexual acts with a person between the ages of 12 and 16, or encourages such an individual to engage in various “perversions” faces a second-degree felony.
  • Lewd or lascivious exhibition – Also known as intentional masturbation or intentional exposure of one’s genitals in a lewd manner. Intentionally exposing your genitals in public is considered a first-degree misdemeanor.
